SunSense Privacy Policy and GDPR Compliance

This Privacy Policy and Notice of Privacy Practices ("Privacy Policy") tells you how SunSense AS and its affiliates (“We” or “SunSense”) protect and use information that we gather or that you may submit through our SunSense Pro Smartphone App, Sunsense.com website or other related applications or websites (collectively, the “Applications”). These Applications and this Privacy Policy are subject to applicable U.S. federal and state laws and regulations.

This Privacy Policy was last revised on the date listed below in the "Changes to Privacy Policy" paragraph. We may change this Privacy Policy at any time and for any reason. We encourage you to review this Privacy Policy each time you visit or submit information to these Applications.

By accessing or using any of these Applications, you agree to the terms of the most recent version of this Privacy Policy. Please read our Terms of Service to understand the general rules about your use of these Applications. Except as written in any other disclaimers, policies, Terms of Service, or other notices on these Applications, this Privacy Policy and the Terms of Service are the complete agreement between you and SunSense with respect to your use of these Applications. You may be subject to additional terms that may apply when you access particular services or materials on certain areas in these Applications, by following a link from these Applications or when you purchase any SunSense product.

Introduction

The information we receive, and how we use it, depends on what you do when visiting our Applications. In the following Privacy Policy, we will outline how we collect data, why we collect that data, what type of data is being collected, and your control of that data. 

How Data is Collected

Activate a SunSense Sensor with connection to the SunSense app

When activating a SunSense Sensor, you will be asked to download the SunSense App and enter information about yourself, such as skin type, skin sensitivity, etc.  We use this information to base our personalized SunSense recommendations. The same information is collected when you use our app without using a sensor.  The SunSense app also collects UV exposure measured by your Sensor.

Create a SunSense Account

If you want to access data collected by a Sensor that can be connected to our app, you must create a SunSense account. When you create a SunSense account, we ask for some personal information, including your email address. Your email address will be your SunSense account username, which you will use to log into your account. We do not share your email address to other users. The same information is collected when you use our app without using a sensor.

Profile image

To personalize the user account, users can upload a profile image. The profile image is uploaded to an external server. It is not used by SunSense or shared with any third parties. The use of a profile image is completely optional and does not affect user experience and/or functionality in the app.

Add info to your account

You can customize your SunSense experience by adding other types of information to your account, such as entering a location, time planned in the sun, sunscreen habits, etc. Whenever you add this type of data, we collect it and store it in your SunSense account.

Visit Our Sites

SunSense collects industry standard data from everyone who visits our Sites—even if you don’t have a SunSense account. This includes log data that automatically records information about your visit, such as your browser type, operating system, the URL of the page that referred you, the different actions you performed, and the IP address you used to access pages on the Site. We use this type of information to provide you with an experience that’s relevant to your location based on the IP address, to prevent Site misuse, and to ensure the Site is working properly. We also collect data from cookies.

Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance whether it’s their first time visiting or if they are a frequent visitor.

The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.
You can control and manage cookies in various ways. Please keep in mind that removing or blocking cookies can negatively impact your user experience and parts of our website may no longer be fully accessible.
Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser controls, often found in your browser’s “Tools” or “Preferences” menu. For more information on how to modify your browser settings or how to block, manage or filter cookies can be found in your browser’s help file or through such sites as www.allaboutcookies.org.
Additionally, please note that blocking cookies may not completely prevent how we share information with third parties such as our advertising partners. To exercise your rights or opt-out of certain uses of your information by these parties, please follow the instructions in the “Behavioural Advertising” section above.

Do Not Track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

Sync your Sensor

When you sync your Sensor through the App, data recorded in your Sensor about your activity is transferred from your Sensor to our servers. This data is stored and used to provide the SunSense and is associated with your account. Each time a sync occurs, we log data about the transmission. Some examples of the log data are the sync time and date, Sensor battery level, and the IP address used when syncing.

Buy from our store

We do not view or store your credit card information. This is handled by our third-party payment processors. We store your shipping address so we can process your order through our fulfilment partner.

Contacting us

Whenever you contact SunSense for help, we collect your name and email address along with additional information you provide in your request so that we can provide you with assistance and improve the SunSense. If you contact us when you are already logged in to your account, the web form automatically pre-fills this information, so you don’t have to type it manually. You can also contact SunSense on public forums such as Twitter or Facebook; however, we cannot maintain the privacy of your communication to us if you contact us through these channels.

Location data

Geolocation via GPS is collected to download correct UV-forecast and calculate atmospheric conditions and solar angle that are important parameters to the continuously updated sensor correction algorithm.

We collect and use your non-personal information (information that is not identifiable to you personally) differently than your personal information.

Why We Collect Data

SunSense uses your data to provide you with the best experience possible, to help you make the most of your time outside, and to improve and protect the SunSense. Here are some examples:

Contact information is used to send you notifications and to inform you about new features or products we think you would be interested in. Please see “Can I Opt-out Of Receiving SunSense Emails?” for information on how you can opt-out of future communications.

Data and logs are used in research to understand and improve the SunSense Sensor and SunSense; to troubleshoot the SunSense; to detect and protect against error, fraud or other criminal activity; and to enforce the SunSense Terms of Service.

What Kinds Of Data We Share

De-identified data that does not identify you

De-identified data that does not identify you may be used to inform the health community about trends, market research or reports about UV exposure and health; for marketing and promotional use; or for sale to interested audiences.

With companies that are contractually engaged in providing us with services, such as order fulfilment, email management and credit card processing. These companies are obligated by contract to safeguard any de-identified data they receive from us.

If we believe that disclosure is reasonably necessary to comply with a law, regulation, valid legal process (e.g., subpoenas or warrants served on us), or governmental or regulatory request, to enforce or apply the Terms of Service or Terms of Sale, to protect the security or integrity of the SunSense, and/or to protect the rights, property, or safety of SunSense, its employees, users, or others. If we are going to release your data, we will do our best to provide you with notice in advance by email, unless we are prohibited by law from doing so.

We may disclose or transfer your de-identified data in connection with the sale, merger, bankruptcy, sale of assets or reorganization of our company. We will notify you if a different company will receive your de-identified data and the promises in this Privacy Policy will apply to your data as transferred to the new entity.

How Long We Save Your Data

We store your de-identified data for as long as you maintain a SunSense account.

How To Deactivate Your SunSense Account

You can deactivate your SunSense account by contacting Customer Support at support@sunsense.no. When you do, data that can identify you will be removed from the SunSense, including but not limited to your email and name. Backup copies of this data will be removed from our server based upon an automated schedule, which means it may persist in our archive for a short period. SunSense may continue to use your de-identified data after you deactivate your account.

Data Storage and Management

Our servers are located in United States and Europe. If you are accessing our Sites or Apps from outside Canada, United States, and China, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information. 

Some non-European Economic Area (EEA) countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards.  For transfers from the EEA to countries not considered adequate by the European Commission, we have ensured that adequate measures are in place, including by ensuring that the recipient is bound by EU Standard Contractual Clauses, or an EU-approved code of conduct or certification, to protect your personal information. We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Information Security 

Security is important to us. We take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should keep in mind that no Internet transmission is ever 100% secure or error-free. Particularly, e-mail sent to or from this site may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

We may ask you to provide additional information to verify your request. We may not discriminate against you if you exercise your rights as described in this notice. For example, we may not deny goods or services to you, or charge you different prices or rates, or provide a different level of quality of products or services.

Right to Information

You have the right to request the following information regarding the personal information we have collected about you:

Our purpose for collecting personal information;

Categories of third parties with which the personal information was shared; and

Specific pieces of personal information collected about consumers.

Right to Request Deletion

You have the right to request that we delete the personal information we have about you. However, we are not required to delete information if it is necessary to retain your information to:

Complete the transaction for which the personal information was collected, provide a good or service requested by you, or a transaction reasonably anticipated within the context of our or one of our affiliate’s ongoing business relationship with you, or to otherwise perform a contract we have with you.

Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity or prosecute those responsible for that activity.

Debug to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
